SOUTHERN TIER DISTILLING COMPANY “VODKA SELTZER COOLER” SWEEPSTAKES
NO PURCHASE NECESSARY TO ENTER OR WIN. MUST BE 21 YEARS OF AGE OR OLDER TO ENTER
ELIGIBILITY: The Southern Tier Distilling Company “Vodka Seltzer Cooler” Sweepstakes (the “Sweepstakes”) begins at approximately 12:01 AM Eastern Time (“ET”) on 10/03/19 and ends at 11:59:59 PM ET on 11/30/19 (the “Sweepstakes Period”). Must be 21 years of age or older at time of entry and a resident of New York. Employees of Southern Tier Distilling Company (“Sponsor”), Sponsor’s advertising/promotional agencies, alcohol beverage licensees (plus immediate family members of all such employees) are not eligible to participate. The term “immediate family members” includes spouses, children, and siblings.
HOW TO ENTER: Post a photo on Facebook or Instagram with the hashtags #vodkaseltzer35 AND #stdcspirits . Both hashtags must be used to be eligible for the Sweepstakes. No purchase is necessary to enter, but an electronic device with social media capabilities is required to enter the Sweepstakes. By entering the Sweepstakes, you authorize Sponsor to send direct messages to your mobile phone number confirming your entry into the Sweepstakes, to notify you if you are a winner, and to receive information on Sponsor’s promotions and offers. The use of script, macro, or automated devices or any other devices intended to automate any aspect of participation is prohibited. If Sponsor determines that an entrant has used an automated or other improper device to participate, all entries from that mobile phone or entrant will be disqualified. All entries must be received by the close of the Sweepstakes Period and become the property of the Sponsor.
PRIZES AND DRAWINGS: On or around 12/02/19, the following winners (each a “Winner”) will be randomly selected from all eligible entries received. All Winners are subject to confirmation of eligibility and will be notified by phone call to the telephone number used to transmit the entry. Grand Prize Winner: Four(4) Prize Winners will be selected and awarded the following prize package: one (1) Southern Tier Distilling Company Branded Yeti 35 Cooler $249.99. The odds of winning the Grand Prize, (also referred to as a “Prize”) in the Sweepstakes will depend upon the number of eligible entries received during the Sweepstakes Period. Sponsor reserves the right to cancel the Sweepstakes depending on number of entrants. All Prizes will be awarded unless Sponsor cannot obtain documentation from a Winner in a timely manner to confirm eligibility in which case a Prize may not be awarded. All other costs not specifically mentioned as included with the Prize including, but not limited to, taxes, personal expenses, and all other costs and expenses incurred in claiming or using the Prize are the responsibility of the Winner to pay. No alcohol is being awarded as part of a Prize. A purchase of any kind will not increase chances of winning.
PRIZE CONDITIONS: Winner must be 21 years of age or older and a resident of NY, NJ, OH, NC, DE, DC. All federal, state, and local taxes are the sole responsibility of the Winner to pay. Prize is not transferable or redeemable for cash. Sponsor will report the value of the Prize awarded as required by law. Sponsor reserves the right, in its discretion, to substitute the Prize with a similar prize of equal or greater value or with a company check for the stated ARV. Winner will be required to provide proof of identity, age, and residency. Sponsor will make two attempts to contact a Winner within a 24 hour period. If a Winner does not respond to Sponsor’s notification of being selected as a Winner within 24 hours from the time of Sponsor’s initial notification, or if a Winner (i) fails to provide to Sponsor any required documents (e.g. Affidavit of Eligibility and Liability/Publicity Release, copy of driver’s license, etc.) within the time specified by Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Winner will be disqualified and the Sponsor will select another winner. Prize acceptance constitutes permission to use Winner’s name and address (city and state only) and likeness for publicity purposes without additional compensation. By entering the Sweepstakes, participants are subject to Sponsor’s Privacy Policy which can be found at https://southerntierdistilling.com/privacy-policy and agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity with regard to the mechanics of the Sweepstakes or interpretation of the Official Rules. No refund or compensation will be paid if the Prize or any component thereof is not used or otherwise declined. Sponsor is not responsible or liable for lost or stolen Prizes once shipped to Winner.
LIMIT OF LIABILITY: Sponsor and its agents and their respective officers, directors, and employees are not responsible for lost, late, delayed, inaccurate, incomplete, or misdirected entries, or for any electronic, network, or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed transmissions that may limit a user’s ability to participate in the Sweepstakes, or for any other hardware, software, or technical errors of any kind including any injury or damage to any person’s computer or mobile phone, or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, or with respect to any Sweepstakes-related materials. Headings are provided for convenience only. Sponsor is not responsible or liable for any loss, injury (including death), damage, inconvenience, or loss of time arising out of any acts, omissions, or negligence, of any person, including, without limitation, the Winner or any person providing any service or accommodation in conjunction with the Prize, or for delays or cancellations including, but not limited to those resulting from mechanical breakdown, closings, strikes, government action, inclement weather, or Acts of God. Winner agrees to release, discharge, indemnify and hold harmless Sponsor and its officers, directors, employees, agents, and affiliates from and against any claims, damages, or liability due to injuries (including death), damages, or losses resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes or use of a Prize. Sponsor is not liable for the actions of the Winner while using a Prize. Any disputes regarding this Sweepstakes shall be governed by New York State law and resolved in courts located in Chautauqua County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred in entering the Sweepstakes and, in no event, attorney fees. By participating, the entrant agrees to waive any rights to bring a claim against Sponsor as a plaintiff or class member in any class action or proceeding and waives any and all claims for punitive, incidental, and consequential damages. Sweepstakes is subject to all applicable federal, state, and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of the Sweepstakes will be declared ineligible and may be prosecuted. If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes, or award the Prize through a random drawing from all eligible entries received which, in Sponsor’s opinion, were not affected by the Intervening Cause. Sponsor makes no warranty as to the merchantability or fitness for a particular purpose of a Prize awarded. Pictures used are for illustrative purposes only.
